Last updated: September 4th, 2026

Please read these Terms of Service ("Terms") carefully before purchasing or using any products from fondement ("we," "us," "our," the "Company"). By placing an order, creating an account, or using this website, you agree to be bound by these Terms.

FDA / Health Canada Disclaimer These statements have not been evaluated by the Food and Drug Administration (FDA) or Health Canada. This product is not intended to diagnose, treat, cure, or prevent any disease. The information provided on this website and on product labeling is for informational purposes only and is not a substitute for professional medical advice. Always consult a physician or qualified healthcare provider before beginning any new supplement, especially if you are pregnant, nursing, have a known medical condition, or are taking prescription medication.

1. Eligibility

Our products are intended for use by adults 18 years of age or older. By purchasing from fondement, you represent that you are at least 18 years old and legally able to enter into a binding contract.

2. Product Disclaimers & Health Information

2.1. Not medical advice. fondement products (including "signal complex" and "gut instinct") are dietary/functional supplements. As noted above, claims regarding these products have not been evaluated by Health Canada, the FDA, or any other regulatory body unless explicitly stated on the product label.

2.2. Consult a healthcare provider. You should consult a physician or qualified healthcare provider before using any fondement product if you are pregnant, nursing, under 18, taking medication, or have any pre-existing medical condition. Discontinue use and consult a doctor immediately if you experience any adverse reaction.

2.3. Allergen disclosure is the customer's responsibility. Full ingredient lists are provided on each product label and product page prior to purchase. It is the customer's sole responsibility to review the ingredient list and consult the product label, a healthcare provider, or both before consuming any product, particularly if the customer has known allergies, sensitivities, or medical conditions. fondement makes no representation that its products are free from allergens or cross-contamination beyond what is expressly stated on the label.

2.4. Assumption of risk. By purchasing and/or consuming fondement products, you knowingly and voluntarily assume all risks associated with their use, including but not limited to allergic or adverse reactions, interactions with medications, or individual sensitivities not disclosed to or reasonably foreseeable by fondement.

3. Limitation of Liability

3.1. To the fullest extent permitted by applicable law, fondement, its officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your purchase or use of our products.

3.2. To the fullest extent permitted by applicable law, fondement's total aggregate liability for any claim arising from or related to a product purchase shall not exceed the amount you paid for the specific product giving rise to the claim.

3.3. Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable consumer protection legislation, including the Quebec Consumer Protection Act and the Civil Code of Québec's legal warranty provisions. Where such laws apply, the limitations above apply only to the maximum extent those laws permit.

4. Sales, Returns & Refunds

4.1. All sales are final. Due to the consumable nature of our products, we do not accept returns or offer refunds or exchanges once an order has shipped, except as required by law or as set out below.

4.2. Damaged or incorrect orders. If you receive a damaged, defective, or incorrect item, contact us at nutritionfondement@gmail.com within 7 days of delivery with photo evidence, and we will assess the issue on a case-by-case basis at our sole discretion.

4.3. Statutory rights preserved. Nothing in this section limits any non-waivable return, refund, or warranty rights you may have under applicable consumer protection law.

4.4. Order cancellations are only accepted before an order has entered fulfillment. Once an order has shipped, it is treated as a final sale under Section 4.1.

5. Indemnification

You agree to indemnify, defend, and hold harmless fondement and its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your misuse of a product; (b) your failure to review product labeling or disclosed ingredients; (c) your violation of these Terms; or (d) your violation of any applicable law.

6.1. We make reasonable efforts to ensure product descriptions, images, and marketing content are accurate, but do not warrant that all content on our website or social channels is error-free, complete, or current.

6.2. Testimonials, reviews, and user-generated content reflect individual experiences and are not a guarantee of results for any other individual.
